Federal Judge Appoints Moze Cowper to Plaintiffs’ Executive Committee in MDL-3181

LOS ANGELES, CA, UNITED STATES, August 17, 2026 /EINPresswire.com/ -- Cowper Law LLP announced today that Managing Partner Moze Cowper has been appointed by United States District Judge Josephine L. Staton to serve on the Plaintiffs’ Executive Committee (“PEC”) in the recently established multi-district litigation involving Boston Scientific Corporation’s spinal cord stimulator products.

The litigation, In re: Boston Scientific Corporation Spinal Cord Stimulator Products Liability Litigation, MDL No. 3181, Case No. 2:26-ml-03181-JLS-E, is pending in the United States District Court for the Central District of California before Judge Staton. In Pretrial Order No. 2, entered August 13, 2026, Judge Staton appointed Cowper as one of four attorneys to the Plaintiffs’ Executive Committee. The PEC will work with court-appointed Co-Lead Counsel to coordinate and manage plaintiffs’ pretrial activities, participate in and chair litigation committees, assign and oversee projects, and perform other work necessary to advance the litigation.

Our job in this litigation will be to determine whether that trust was justified and, where patients have been injured, to hold the responsible parties accountable.”

Problems Associated With Spinal Cord Stimulators
Spinal cord stimulators are surgically implanted medical devices designed to treat chronic pain by delivering electrical impulses to the spinal cord. Although these devices can provide meaningful relief for some patients, spinal cord stimulation systems also carry significant potential risks and complications. Reported problems associated with SCS systems include lead migration, lead breakage, device and battery failure, loss of effective stimulation, unintended or painful overstimulation, electrical and hardware malfunctions, infection, and the need for revision or explant surgery. FDA adverse-event reports involving Boston Scientific devices have described, among other issues, lead migration accompanied by pain and overstimulation, inadequate stimulation despite repeated reprogramming, and implanted pulse generators requiring surgical replacement.

The lawsuits consolidated in the MDL allege that patients implanted with Boston Scientific spinal cord stimulation systems suffered serious injuries and complications associated with the devices. The litigation will examine, among other issues, the design, manufacture, testing, labeling, warnings and performance of the devices, as well as Boston Scientific’s knowledge of reported problems associated with its spinal cord stimulation systems. Boston Scientific is expected to contest plaintiffs’ allegations, and no determination of liability has been made.

About the Appointment
Judge Staton’s August 13, 2026 order established a leadership structure consisting of three Co-Lead Counsel, Plaintiffs’ Liaison Counsel, a four-member Plaintiffs’ Executive Committee, a Plaintiffs’ Steering Committee and a Leadership Development Committee.

Cowper was appointed to the four-member Executive Committee along with Ashleigh Raso of Nigh Goldenberg Raso & Vaughn, Richard Hood of The Wilhite Law Firm, and Trevor B. Rockstad of Davis & Crump, P.C. The Court directed the Executive Committee to support Co-Lead Counsel in the overall coordination and management of plaintiffs’ pretrial activities, work with other leadership committees to assign and support litigation projects, and chair and participate in committees established by Co-Lead Counsel.
